Terms and Conditions Governing Participation in the ”Magic Weekend” Competition



PLEASE NOTE THAT THIS PROMOTIONAL COMPETITION IS CO-PROMOTED BY COCA-COLA AFRICA (PTY) LTD (“Coca-Cola Africa”) AND MR DELIVERY (PTY) LTD (“Mr D Food”). The following terms and conditions apply exclusively to the aforementioned Competition:

 1. Co-promoters 

This Promotional Competition (“Competition”) is co-promoted by Coca-Cola Africa and Mr D Food (collectively the “Promoters”). Each Party shall be solely responsible for the administration of their respective roles in respect of the Promotional Competition and warrants that in so doing, it shall comply with all applicable provisions of the Consumer Protection Act, 68 of 2008. In line with the requirements of the Consumer Protection Act 68 of 2008, Mr D Food will be responsible for running the draws, selecting the winner and communicating with the selected winner prior to delivery of prizes and obtaining the winner’s consent to share such information with the Co- Promoter. 

2. Competition Period 

The Competition shall commence at 08h00 (Central African Time) on Monday 16 May 2022 and end at 22h00 (Central African Time) on Sunday 26 June 2022 (the “Competition Period”). 

3. Who Can Enter

 3.1. The Competition is open to: (i) natural persons who are at least 18 years old residing in South Africa and who are in possession of a valid form of identification (South African Identity Document or Passport); (ii) who have a valid Mr D Food account; and (iii) it being lawful for such persons to be awarded the particular prize. Persons ARE NOT ALLOWED to participate in this Competition if they are a minor, employee, director, member, partner, agent or consultant of the Promoters, or any person who directly or indirectly controls or is controlled by either Promoter and/or immediate family members of any of the above persons, its advertising agencies, advisers, dealers, suppliers and Bottlers of beverages identified by the trademarks owned by or licensed to The Coca-Cola Company , its affiliates and/or associated companies or any persons who have won a prize in a competition run by Coca-Cola Africa in the past 6 (six) months.

 3.2. By entering the Competition, all participants and the winners agree to be bound by these terms and conditions. The Promoters reserve the right at any time, without notice, to amend, modify, or change these terms and conditions and any prizes, and to postpone, suspend or cancel this Competition and any prizes, or any aspect thereof, without notice at any time, for any reason which is beyond the Promoters’ reasonable control.

 3.3. The Competition is only valid within South Africa. Participants must be within South Africa at the time of entering the Competition, for the verification process and at the time the prizes are awarded should they be declared a winner, failing which such person will be disqualified and the draw of a replacement entry shall take place under the same terms and conditions as the first draw. 

4. The Prize

 4.1. The Participants stand a chance to win 

4.1.1.Grand prize: one weekend away to Durban in KwaZulu-Natal, South Africa for a family of 4 people i.e. winner and 3 travel companions from Friday to Sunday including all meals (breakfast, lunch and dinner), transport , car hire in Durban for the winner to drive during the weekend away, ticket entries into Ushaka Marine World on Saturday and travel insurance. This prize is subject to availability at the time of booking. Winner and the winner’s travel companions must be in the same place where they will be picked up and will be dropped off at the same place. The total value of this prize is R95 935.00 (ninety-five thousand nine hundred and thirty-five rands). Winner and winner’s travel companions must be available to travel to the weekend away on the dates that will be determined by Coca-Cola Africa. Coca-Cola Africa will at it sole discretion, select the transport, travel insurance, hotel, type of hotel room and the tickets for Ushaka Marine World. The travel itinerary for the weekend getaway will be provided to the winner prior to the travel dates. Travel is subject to these terms and conditions. The Promoters are not responsible in the event that the booking for the weekend away is postponed, or cancelled for any reason beyond their control, including but not limited to pandemics, epidemics, local disease outbreaks, public health emergencies, rules from any government authority, lockdown or stay at home orders and quarantines. Winner understands and agrees that the Promoters have the right, in their sole discretion, to disqualify and remove a winner or a winner’s companion from any activity at any time if the winner or the winner’s companion behavior at any point is uncooperative, disruptive, or may or does cause damage to person, property, or the reputation of the Promoters. All expenses, travel, and other costs not expressly stated in the prize package description above are the sole responsibility of the winner. Winner and travel companion are responsible for complying with any and all COVID-19 requirements set forth by the Promoters, hotels/accommodations, car hire service and government authorities. Failure to comply with any required COVID-19 requirements, may result in forfeiture of select elements of the prize or the entire prize. Coca-Cola Africa reserves the right to substitute the prize for one of equal value if the designated prize should become unavailable for any reason. Winner is responsible for all taxes, fees and other costs associated with prize receipt and/or use; or

4.1.2  Weekly hamper prizes: 1 of 10 x Magic weekend hampers, comprising of the following Coca-Cola-branded items: 5 (five) x pillows, 5 (five) x fleece blankets, 1 (one) x bean bag], 4 (four) x floor pillows, 5 (five) x plastic cup with straws and 1 pair of socks. Each hamper is estimated to be valued at R8500,00 (eight thousand ,five hundred rand). Coca-Cola Africa will, at its sole discretion, select the brands of the pillows, blankets, bean bag, cups and socks. The hamper prize winners will be drawn each week for the duration of the Competition Period and there will therefore be a total of 10 hamper prize winners each week for the duration of the Competition Period. 

4.2. There will only be a total of 1 (one) winner for the grand prize and a total of 60 (sixty) winners for the hamper prizes. 

4.3.   Each prize is not transferable and may not be exchanged for cash or any other item.

5.     How To Enter

5.1. To enter this Competition, participants will be required to log in to their Mr D Food account via the Mr D Food App, AND complete in full at least one purchase of any ‘Coca Cola’ beverage item via the Mr D Food App.

5.2.     Participants may enter the Competition subject to the following:

5.2.1. All entries must be made by a natural person on the Mr D Food App.

5.2.2. If any entry was made in a manner which provides the participant with an unfair advantage over other entrants, such a participant will be disqualified from this Competition.

5.2.3.Participants may enter this Competition as many times as they like provided they complete the entry mechanics set out above each time. However, participants are only eligible to stand a chance to win  1 (one) prize under this Competition.

5.3.For the hamper prizes, Mr D Food will run an audited random draw for the presumptive winners, every Tuesday after the first week of the commencement of the Competition. The presumptive winners will be notified via email, to their registered Mr D Food account email address, by Mr D Food within five (5) working days after the conclusion of any draw. Each presumptive winner will be required to provide their proof of identification, including their full name, contact number, e-mail address and address (collectively “Participation Information”), for verification purposes. Mr D Food will further request consent from each presumptive winner to share the Participation Information with the third party contractors it engages to manage the execution of its obligations in terms of this Competition, and Coca-Cola Africa for delivery of the prize. Once the presumptive winner has been successfully verified and consented for Mr D Food to provide their Participation Information to Coca-Cola Africa for delivery of the Prize they will be confirmed as a winner, and Coca-Cola Africa will then communicate with the winner via email regarding when, where (i.e. within the Republic of South Africa) and how they will receive their prize. The winner will receive their prize within 14 (fourteen) working days from being notified by Mr D Food. 

5.4.For the grand prize, all entries will be reviewed by a panel of judges who will short-list the valid entries. Mr D Food will run an audited random draw on the valid entries, within 5 working days after the end of the Competition, to select the presumptive winner. The presumptive winner will be notified via email, to their registered Mr D Food account email address, by Mr D Food within five (5) working days after the conclusion of the draw. Each presumptive winner will be required to provide their proof of identification, including their full name, contact number, e-mail address and address (collectively “Participation Information”) for verification purposes. Mr D Food will further request consent from each presumptive winner to share the Participation Information with the third party contractors it engages to manage the execution of its obligations in terms of this Competition, and Coca-Cola Africa for delivery of the prize. Once the presumptive winner has been successfully verified and consented for Mr D Food to provide their Participation Information to Coca-Cola Africa for delivery of the Prize they will be confirmed as a winner, and Coca-Cola Africa will then communicate with the winner via email regarding when, where (i.e. within the Republic of South Africa) and how they will receive their prize.

5.5. Once the winner has received the prize, the Promoters will not take responsibility for any service malfunction or defect.  Ownership of and risk in and benefit attached to the prize will pass on to the winner immediately.

5.6. The prize winner is obligated to behave responsibly and comply with the terms and conditions and all reasonable requests of the Promoters and their agents.

6.        Disqualification of presumptive winners or official winners            

If either Promoter (as the case may be) is unable to reach a winner after 48 (forty eight) hours from the date of the winner being notified that they have won the prize,  or if a presumptive winner fails the verification process after drawing his/her entry; or does not provide consent to share their Participant Information so that the co-promoters can comply with their obligations under this agreement, such person will be disqualified and a draw for a replacement entry and winner will take place

7.         Use of Participant and Winner Information

7.1. All participants and the winner, as the case may be, indemnify the Promoters, their advertising agencies, advisers, nominated agents, partners, suppliers and Bottlers of beverages identified by the trademarks owned by or licensed to the Promoters, their affiliates and/or associated companies against any and all claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in this Competition (including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Promoters and/or receipt of the prizes and/or use of the prizes).

7.2. The Promoters may require the winner to be identified, photographed and published in printed media, or to appear on radio and television, when accepting the prize or after having received the prize, but the winner will be entitled to decline to do so.

7.3. By entering the Competition, the participants agree that their personal information may be shared with third party service providers engaged by the Promoters for the execution of compliance with the Consumer Protection Act requirements and to effect the delivery of the prize. Such personal information will be used only to the extent that it is necessary for administering this Competition and in accordance with the provisions of the Protection of Personal Information Act, 4 of 2013 (“POPI Act”). The participants further agree that Coca-Cola Africa and its affiliates (including subsidiaries, Bottlers, and joint ventures) may contact the participants via email and through social media platforms to deliver marketing communications regarding their products and promotional activities, subject to the provisions of the POPI Act Coca-Cola Africa may use the winner’s personal information in accordance with the provisions set out in the Privacy Policy accessible at www.coca-cola.co.za and that such use may include transfers to Coca-Cola Africa’s affiliates and third party service providers in any country.

7.4. The Promoters may require the winner to complete and submit an information disclosure agreement and indemnification to enable the Promoters to ensure compliance with these terms and conditions as well as the Consumer Protection Act 68 of 2008. Should any winner refuse or be unable to comply with this clause for any reason, such a winner will be deemed to have rejected the prize and it shall revert back to CocaCola Africa.

7.5. By posting any content, experiences, images on any social media platform, in relation to this Competition and its associated promotional activities, participants consent and give Coca-Cola Africa a world-wide, royalty free and non-exclusive license, to reproduce, modify, adapt and publish any content posted and/or submitted by a participant on a social media platform, for the purposes of promoting the products and services of Coca-Cola Africa.

          8.     Unforeseen events

In the event of unforeseen circumstances or causes beyond the Promoters’ reasonable control, the Promoters reserve the right to cancel this Competition (before entries are received), to change the number or nature of the prize at any time (on notice to you), or to change the rules at our discretion (provided that we will not change the conditions for participation or conditions for being awarded the prize, as stated herein).
