Coca-Cola Festive Competition Terms & Conditions


 The following terms and conditions apply exclusively to the aforementioned Competition:

1.    Co-promoters

This Promotional Competition (“Competition”) is co-promoted by Coca-Cola Africa and Mr D Food (collectively the “Promoters”). Each Party shall be solely responsible for the administration of their respective roles in respect of the Promotional Competition and warrants that in so doing, it shall comply with all applicable provisions of the Consumer Protection Act, 68 of 2008.

2.    Competition Period          

The Competition shall commence at 08h00 (South African time) on 22 December 2021 and end at 22h00 (South African time) on 31 December 2021 (the “Competition Period”).


3.    Who Can Enter:

3.1.         The Competition is open to: (i) natural persons who are at least 18 years old residing in South Africa and who are in possession of a valid form of identification (South African Identity Document or Passport); (ii) who have a valid Mr D Food account; and (iii) it being lawful for such persons to be awarded the particular prize. Persons ARE NOT ALLOWED to  participate in this Competition if they are a minor, employee, director, member, partner, agent or consultant of the Promoters, or any person who directly or indirectly controls or is controlled by either Promoter and/or immediate family members of any of the above persons, its advertising agencies, advisers, dealers, suppliers and Bottlers of beverages identified by the trademarks owned by or licensed to The Coca-Cola Company , its affiliates and/or associated companies.

3.2.         By entering the Competition, all participants and the winners agree to be bound by these terms and conditions. The Promoters reserve the right at any time, without notice, to amend, modify, or change these terms and conditions and any prizes, and to postpone, suspend or cancel this Competition and any prizes, or any aspect thereof, without notice at any time, for any reason which is beyond the Promoters’ reasonable control.

3.3.         The Competition is only valid within South Africa.  Participants must be within South Africa at the time of entering the Competition, for the verification process and at the time the prizes are awarded should they be declared a winner, failing which such person will be disqualified and the draw of a replacement winner shall take place under the same terms and conditions as the first draw.


4.    The Prize:

4.1.         Participants stand a chance to win one (1) of two-hundred and fifty (250) Mr D Food and Coca-Cola voucher codes valued at a total of Forty Rand (R40) each. The voucher code may be used to purchase any of the following two (2): Coca-Cola Original; Coca-Cola No Sugar; and Coca-Cola Zeros in one or two separate transactions on the Mr D Food App when placing a food order at a participating restaurant/store on the Mr D Food App. The voucher code must be supplied at checkout to qualify for a free Coca-Cola beverage when placing a food order at a participating restaurant  / store on the Mr D Food App. At the winner’s discretion, the voucher code may be shared with the friend that the winner tagged in the Qualifying Entry so that the friend can redeem both or one Coca-Cola beverage.  The 250 winners will be selected at random by Mr D Food at the end of the Competition Period. Winners will be selected from the Qualifying Entries submitted during the Competition Period.

4.2.         The Prize is not transferable and may not be exchanged for cash or any other item.

4.3.         In order to receive the Prize, participants must ensure that their Twitter Direct messaging is activated.


5.    How To Enter:                 

To enter, a Mr D Food customer must, during the Competition Period go on Mr D Food’s Twitter Social Media post where Mr D Food is advertising the Share a Real Magic Moments with Coke® with a friend Campaign on the  Mr D Food social media post and on the post, the customer must  comment, tag a friend and use the hashtag #RealMagic  in the comment (“Qualifying Entry (ies)”), to stand a chance to win one of two hundred and fifty (250) voucher codes to qualify for the free Coca-Cola beverage offering on the Mr D Food App, when placing a food order at a participating restaurant/ store.

5.1.          A participant will be able to enter this Competition multiple times..

5.2.         After the Competition Period, Mr D Food will announce via its Twitter Social media Page that winners have been selected and participants should check their Twitter direct messages to confirm if they have won a voucher.

5.3.         Participants may enter the Competition subject to the following:

           i.          All entries must be made by a natural person to the Mr D Food email address indicated.

          ii.          If any entry was made in a manner which provides the participant with an unfair advantage over other entrants, such a participant will be disqualified from this Competition.

         iii.          Participants may enter this Competition as many times as they like provided they complete the entry mechanics set out above each time. However, participants are only eligible to stand a chance to win 1 (one)  of the voucher Prizes.

         iv.          Participants must ensure that the Direct Messaging function on their Twitter Social Media account is activated.


6.                Winners

6.1.         Mr D Food will run an audited random draw from the Qualifying Entries submitted  during the Competition Period to select the winners who have taken the steps set out above and who are in compliance with these terms and conditions. The Prize winners will be announced on 3 January 2022 via the Mr D Food Twitter Social Media page at the end of the Competition Period. Mr D will contact the winner via Direct Messaging on the winners Twitter Social Media account to request the winner’s  name, surname, email address, ID number and telephone number (“Participant Information’’). Mr D Food will make two direct attempts to obtain such information. Once  this information is received and validated,  representatives of Mr D Food will deliver the voucher prize via a Direct Message on the winners Twitter Social Media account, once the  Participant Information has been verified, subject to section 8 below. Proof of identity may be required in order to validate the winner. The Promoters’ decision is final and no correspondence will be entered into regarding the application of these terms and conditions, the selection of a winner, and the prize .

6.2.         Subject to applicable law, once the winner has received the prize, the Promoters will not take responsibility for any service malfunction or defect.  Ownership of and risk in and benefit attached to the prize will pass on to the winner immediately.          

6.3.         A winner is obligated to behave responsibly and comply with the terms and conditions and all reasonable requests of the Promoters and their agents.


7.    Disqualification of Winner:

There are certain situations in which a winner will be disqualified from receipt of his/her prize, namely: (i) he/ she did not activate the Direct Messaging function on their Twitter account (ii) he/she fails to provide Participant Information when requested by Mr D Food for the second time; (iii) he/she is found to have contravened any other rule set out herein; or (iv) in anticipation of delivery of the prize, he/she refuses to or cannot provide reasonably sufficient documentation to verify his/her identity; (v) he/ she does not consent to the sharing of their Participant Information with the Promoters, their  agents, contractors and the third party engaged by the Promoters to effect their obligations in terms of this Competition. In the event of disqualification of a particular winner, Mr D Food will be entitled in its sole discretion to select another winner from amongst the Qualifying Entries submitted.


8.    Use of Participant and Winner Information

8.1.         All participants and the winner, as the case may be, indemnify the Promoters, their advertising agencies, affiliates, advisers, nominated agents, partners, suppliers and Bottlers of beverages identified by the trademarks owned by or licensed to the Promoters, their affiliates and/or associated companies against any and all claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in this Competition (including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Promoters and/or receipt of the prizes and/or use of the prizes).

8.2.         The Promoters may require the winners to be identified, photographed and published in printed media, or to appear on radio and television, when accepting the prize or after having received the prize, but a winner will be entitled to decline to do so.

8.3.         By entering the Competition, the participants agree that their personal information may be shared the Promoters, and third-party service providers engaged by the Promoters for the execution of compliance with the Consumer Protection Act requirements and to effect the delivery of the prize. Such personal information will be used only to the extent that it is necessary for administering this Competition and in accordance with the provisions of the Protection of Personal Information Act, 4 of 2013 (“POPI Act”).

8.4.         The Promoters may require a winner to complete and submit an information disclosure agreement and indemnification to enable the Promoters to ensure compliance with these terms and conditions as well as the Consumer Protection Act 68 of 2008. Should any winner refuse or be unable to comply with this clause for any reason, such a winner will be deemed to have rejected the prize and Mr D Food will be entitled in its sole discretion to select another winner from amongst the Qualifying Entries submitted.

By posting any content, experiences, images on any social media platform, in relation to this Competition and its associated promotional activities, participants consent and give the Promoters a world-wide, royalty free and non-exclusive license, to reproduce, modify, adapt and publish any content posted and/or submitted by a participant on a social media platform, for the purposes of promoting the products and services of the Promoters.

9.    Unforeseen events

In the event of unforeseen circumstances or causes beyond the Promoters’ reasonable control, the Promoters reserve the right to cancel this Competition (before entries are received), to change the number or nature of the prize at any time (on notice to you), or to change the rules at our discretion (provided that we will not change the conditions for participation or conditions for being awarded the prize, as stated herein).

This Agreement may be signed in separate counterparts, each of which shall be deemed to be an original and all of  which taken together shall constitute one and the same instrument. The Parties acknowledge and agree that by signing this Agreement electronically, they are legally bound by the terms and conditions contained in the Agreement and further agree not to contest the admissibility or enforceability of the electronically signed Agreement in any proceedings arising out of the Agreement. To this end, the Parties agree that the electronically signed Agreement shall, for all purposes, have the same legal validity and enforceability as an originally executed copy of this Agreement.
